D03-2023-020    Location:   2647 County Road 36
                                               Concession 7; Part Lot 6

The purpose of the proposed consent is to permit the creation of an agricultural surplus dwelling lot at 2647 County Road 36. The existing lands contain a single detached dwelling and various farm buildings and structures on approximately 38.75 hectare (96.9 acres) of farm land.  The owner of the farm operation resides in another dwelling on a nearby farm lot and the dwelling that is subject of this application is surplus to his use.

Through the severance, approximately 0.75 hectare (1.9 acre) would be severed from the farm parcel at 2647 County Road 36 to contain the existing dwelling, well, and septic system with about 102 metres of frontage on County Road 36 and depth of about 90 metres.

It is proposed, as part of this application that most of the farm buildings and structures on the existing farm lands would be removed, such that only an existing grain bin and silo would remain with the farm lands. In addition, the retained parcel would be rezoned as part of this application, to prohibit future dwellings on the retained lands.

The purpose of the proposed consent is to permit seven (7) vacant residential lots on two parcels of land within the Hamlet of Valentia.

It is proposed that there will be two (2) residential lots created on a parcel known as CON A PT LOT 21, W/S Valentia Road, Mariposa that has been in agricultural use.  Part of the agricultural parcel lies within the settlement area of the Hamlet of Valentia.  The proposed lots would be contained within the hamlet area and consist of the following parcels:

  • Lot 1, having frontage of 38 metres on Valentia Road by approximately 106 metres in Depth and Area of about 4026 sq. metres, 
  • Lot 2, having frontage of 38 metres on Valentia Road by approximately 106 metres in Depth and Area of about 4026 sq. metres,
  • Retained Agricultural Parcel, having frontage of 263.1 metres on Elm Tree Road and 576.81 metres on Valentia Road and Area of about 31.1 hectares (irregular-shape), will contain the three (3) existing agricultural structures.

Further, it is proposed that there will be five (5) residential lots created on a parcel known as MARIPOSA CON A PT LOTS 21 and 22 RP 57R10495 PART 1, being 110 Valentia Road, which has been in agricultural use.  Part of the agricultural parcel lies within the settlement area of the Hamlet of Valentia.  The proposed lots would be contained within the hamlet area and consist of the following parcels:

  • Lot 1, having frontage of 38 metres on Valentia Road by approximately 106.8 metres in Depth and Area of about 4061.2 sq. metres, 
  • Lot 2, having frontage of 38 metres on Valentia Road by approximately 106.8 metres in Depth and Area of about 4055.8 sq. metres,
  • Lot 3, having frontage of 38 metres on Valentia Road by approximately 110 metres in Depth and Area of about 4180 sq. metres, 
  • Lot 4, having frontage of 38 metres on Valentia Road by approximately 110 metres in Depth and Area of about 4180 sq. metres,
  • Lot 5, having frontage of 38.8 metres on Valentia Road by approximately 110 metres in Depth and Area of about 4226.3 sq. metres, and
  • A retained Agricultural Parcel, having frontage of approximately 584.9 metres on Valentia Road and Area of about 41.49 hectares (irregular-shape) containing the existing buildings and structures including one residential dwelling and various agricultural buildings and structures.

The purpose of the proposed consent is to permit a lot addition to 6660 Ontario Highway No. 35, where there is an existing dwelling and sheds.  The current lot is approximately 699.9 sq. metres (7533.66 sq. feet) in size. 

Through the severance, approximately 62.67 sq. metres (674.57 sq. feet) of land (irregular-shaped) would be transferred from 6666 Ontario Highway No. 35, to 6660 Ontario Highway 35 (the benefitting lot).  The result would increase the size of 6660 Highway 35 to about 762.57 sq. metres (8208.23 sq. feet).

The resulting retained parcel at 6666 Ontario Highway No. 35 would be approximately 620.98 sq. metres (6684.17 sq. feet) in size.

The purpose of the proposed consent is to permit a lot addition to 1 Adelaide Street North, where there is an existing dwelling.  The current lot is 1248.62 sq. metres (13,440 sq. feet) in size. 

Through the severance, approximately 370.13 sq. metres (3984 sq. feet) of land (irregular-shaped) would be transferred from 7 Adelaide Street North, to 1 Adelaide Street North (the benefitting lot).  The result would increase the size of 1 Adelaide Street North to about 1618.75 sq, metres (17424.08 sq. feet).

The resulting retained residential parcel at 7 Adelaide Street North would be approximately 703.66 sq. metres (7574.16 sq. feet) in size.

The purpose of the application is for a transfer for the creation of a new lot at 653 Hickory Beach Road.  The subject lands have approximately 51.2 metres (168 feet) frontage on Edgewood Drive and are about 1.2 hectares (2.96 acres) in area.

The proposed severed parcel would have approximately 25.61 metres (84 feet) of frontage on Edgewood Drive, about 42.49 metres (139.4 feet) of frontage on Sturgeon Lake, depth of 176.2 metres (578 feet) and be 0.60 hectares (1.49 acres) in area.  The new parcel would contain an existing boathouse and take access from Hickory Beach Road.

The retained lands would have approximately 25.61 metres (84 feet) of frontage on Edgewood Drive, about 41.14 metres (135 feet) frontage on Sturgeon Lake, depth of 176.2 metres (578 feet) and be 0.5806 hectares (1.43 acres) in area.  The retained parcel would contain the existing single detached dwelling and a shed and would require a new access from Edgewood Drive.

The purpose of the application is for a lot addition to address an encroaching attached garage at 5 Elm Street.  The contributing property at 7 Elm Street is approximately 1408 sq. metres (15156 sq, feet) in area.

The proposed lot addition would involve the severance of a triangular shaped parcel from 7 Elm Street measuring approximately 12 metres (39.4 feet) by 3 metres (9.84 feet) by 12.37 metres (40.6 feet) and having an area of 18 sq. metres (194 sq. feet); to be added to 5 Elm Street, the benefitting lot.

The retained lands at 7 Elm Street would be approximately 1390 sq. metres (14962 sq. feet) in area.

If a person or public body that files an appeal of a decision of the City of Kawartha Lakes in respect of a proposed consent does not make written submissions to the City of Kawartha Lakes before it gives or refuses to give a provisional consent, the Ontario Land Tribunal may dismiss the appeal.
