Notice of Public Hearing for Minor Variance

Take notice, that the Committee of Adjustment of the City of Kawartha Lakes will hold a Public Meeting on September 19, 2019 at 1:00pm in the Council Chambers City Hall, 26 Francis Street, Lindsay, Ontario, to consider minor variance/permission applications D20-2019-034, D20-2019-038, D20-2019-039, D20-2019-040 and D20-2019-041. A number of applications will be considered at this meeting. The applications are considered in the order that they appear on the Agenda and it may take some time before an application is dealt with at the meeting. The minor variance/permission applications being considered are listed below:

D20-2019-034 –563 County Road 121, Concession 9, Part Lot 22, Plan 49, Part Block E, F and G, Part Lot 19 and 20, Part Dick Street, Part 1, geographic Township of Fenelon, Ward 3, now in the City of Kawartha Lakes – To consider relief under Section 45(1) of the Planning Act, R.S.O., as amended, from the Township of Fenelon Zoning By-law 12-95, as amended. The purpose and effect is to permit an expansion to the existing retail store by requesting relief from the following provisions:

  1. to reduce the minimum rear yard requirement from 12.0 metres to 7.0 metres.
  2. to increase the ratio (reduce the number) of minimum required parking spaces for commercial use from 1 space per 30 square metres of Gross Floor Area (180 spaces) to 1 space per 37 square metres of Gross Floor Area (149 spaces).
  3. to reduce the minimum aisle width from 7.0 metres to 6.0 metres.
  4. to allow for loading spaces and doors on a wall which faces the street, provided that wall is not the primary wall of the building.
  5. to allow for an accessory building in the form of a pump house in the front yard.
  6. to allow for accessory buildings in the form of temporary storage containers in the front yard for a period not to exceed November 30, 2021 or until construction is completed, whichever is lesser.

D20-2019-038 – 788 Indian Point Road, Range North West Bay, Part Lot 3, Plan 378, Lot 29, geographic Township of Bexley, Ward 1, now in the City of Kawartha Lakes – To consider relief under Section 45(1) of the Planning Act, R.S.O., as amended, from the Township of Bexley Zoning By-law 93-09, as amended. The purpose and effect is to permit the construction of detached garage, including additions to a single-storey waterfront dwelling that will comprise of a walkout basement, a covered front porch, an attached garage, a sunroom, and a rear elevated deck with stairs. Relief is sought from the following provisions:

Addition of an Elevated Deck exceeding 1.2 metres above ground to a Dwelling

  1. to reduce the minimum water setback from 15 metres to 13 metres.

Detached Garage

  1. to increase the maximum height requirement for an accessory building from 5 metres to 6 metres.

D20-2019-039 – 344 Lindsay Street South, Part Lot 16, Concession 6, geographic Township of Ops, Ward 7, now in the City of Kawartha Lakes – To consider relief under Section 45(1) of the Planning Act, R.S.O., as amended, from the Township of Ops Zoning By-law 93-30, as amended. The purpose and effect is to request relief to permit an approximately 278 square metre addition to a legal non-conforming body shop use.  

D20-2019-040 – 726 Balsam Lake Drive, Range North West Bay, Part Lot 16, geographic Township of Bexley, Ward 1, now in the City of Kawartha Lakes – To consider relief under Section 45(1) of the Planning Act, R.S.O., as amended, from the Township of Bexley Zoning By-law 93-09, as amended. The purpose and effect is to request relief to reduce the minimum side yard setback for an accessory building from 1.2 metres to 0.6 metres in order to permit the construction of a new boathouse.

D20-2019-041 – 18 Church Street, Part Lot 9 & 11, Plan 42, geographic Township of Mariposa, Ward 4, now in the City of Kawartha Lakes – To consider relief under Section 45(1) of the Planning Act, R.S.O., as amended, from the Township of Mariposa Zoning By-law 94-07, as amended. The purpose and effect is to permit the replacement of a derelict single-storey dwelling with a new single-storey detached bungalow on a reconfigured footprint that will comprise of a basement area and a covered deck on the main level by requesting relief from the following provisions:

  1. to reduce the minimum exterior side yard setback from 7.5 metres to 4.3 metres along Church Street; and
  2. to reduce the minimum rear yard setback from 7.5 metres to 5.5 metres.

Any person may attend the hearing and/or make written comments to the City of Kawartha Lakes, Committee of Adjustment, 180 Kent Street West, Lindsay, Ontario, K9V 2Y6, either in support of, or in opposition to the proposed Minor Variances or Permission.

 

The Committee will make a decision according to information or evidence received before and during the hearing.

Any person or persons who wish to be notified of the recommendation and/or the decision with respect to these applications must appear in person or by counsel at the Public Hearing and in addition, request in writing from the Secretary-Treasurer copies of the decision of the Committee of Adjustment.

Additional information regarding these applications will be available for public inspection at Development Services – Planning Division, Lindsay Service Centre, 180 Kent Street West, Lindsay, Ontario during regular office hours from 8:30am to 4:30pm Monday to Friday.
