Notice of Public Hearing for Minor Variance - Committee of Adjustment

Take notice, that the Committee of Adjustment of the City of Kawartha Lakes will hold a Public Meeting on September 21, 2017 at 1:00 p.m. in the Council Chambers, City Hall, 26 Francis Street, Lindsay, Ontario, to consider minor variance/permission applications D20-17-034, D20-17-035, D20-17-036, D20-17-037, D20-17-038 and D20-17-040. A number of applications will be considered at this meeting. The applications are considered in the order that they appear on the Agenda and it may take some time before an application is dealt with at the meeting. The minor variance/permission applications being considered are listed below:

D20-17-034 – Adjacent to 52 Mason Lane, Part Lot 10, 11, and 12, Front Range, Parts 1-9, 14, 16, 18 and 19, 57R-797, geographic Township of Somerville, Ward 3, now in the City of Kawartha Lakes – To consider relief under Section 45(1) of the Planning Act, R.S.O., as amended, from the Somerville Zoning By-law 78-45, as amended. The purpose and effect is to request relief to reduce the minimum water setback from 15 metres to 3.8 metres to permit an existing shed.

D20-17-035 – 1059 County Road 46, Part Lot 2, Concession 2, geographic Township of Eldon, Ward 4, now in the City of Kawartha Lakes – To consider relief under Section 45(1) of the Planning Act, R. S. O., as amended, from the Eldon Zoning By-law 94-14, as amended.  The purpose and effect is to request relief to reduce the interior side yard setback from 5 metres to 4.89 metres in order to facilitate the construction of a single detached dwelling.

D20-17-036 – 2 Erin Drive, Plan M714, Lot 32, geographic Township of Manvers, Ward 16, now in the City of Kawartha Lakes – To consider relief under Section 45(1) of the Planning Act, R.S.O., as amended, from the Manvers Zoning By-law 87-06, as amended. The purpose and effect is to request relief to permit the construction of an above ground pool 4.3 metres from a flankage lot line where 15 metres is required.

D20-17-037 – 59 Murray Street, Lot 140 E/S Murray, Plan 100, former Village of Fenelon Falls, Ward 6, now in the City of Kawartha Lakes – To consider relief under Section 45(1) of the Planning Act, R. S. O., as amended, from the Fenelon Falls Zoning By-law 89-25, as amended. The purpose and effect is to request relief to increase lot coverage from 5% to 6.9% to permit construction of a detached garage.

D20-17-038 – 89 Fell’s Point Road, Part Lots 31 & 32, Concession 11, Part 2, 57R-9773, geographic Township of Fenelon, Ward 6, now in the City of Kawartha Lakes – To consider relief under Section 45(1) of the Planning Act, R. S. O., as amended from the Township of Fenelon Zoning By-law 12-95, as amended.  The purpose and effect is to request relief:

  1. In order to permit construction of an addition to a dwelling:
    1. to reduce the required parking spaces from 2 to 1;
    2. to reduce the minimum front yard from 7.5 metres to 6.1 metres; and
    3. to reduce the minimum water setback from 15 metres to 10.4 metres;
  2. In order to permit construction of a gazebo:
    1. to reduce the minimum setback to a residential building from 1.2 metres to 1 metre; and
    2. to reduce the minimum water setback from 15 metres to 7.1 metres;
  3. In order to permit construction of an addition to a dwelling and gazebo:
    1. to reduce the minimum lot area from 745 square metres to 440 square metres; and
    2. to increase the maximum lot coverage from 30% to 35.2%.

D20-17-040 – 2021 Pigeon Lake Road, Plan 308, Lot 3, geographic Township of Emily, Ward 14 now in the City of Kawartha Lakes To consider relief under Section 45(1) of the Planning Act, R. S. O., as amended, from the Township of Emily Zoning By-law 1996-30, as amended. The purpose and effect is to permit the construction of an addition to an existing single detached dwelling by requesting relief:

  1. to reduce the minimum rear yard setback from 7.5 metres to 6.1 metres; and
  2. to reduce the minimum lot area required for an existing lot of record from 930 square metres to 929 square metres; and

To request relief to reduce the minimum distance an accessory building may be from a rear lot line from 1.0 metre to 0.76 metres to recognize the location of an existing shed.

Any person may attend the hearing and/or make written comments to the City of Kawartha Lakes, Committee of Adjustment, 180 Kent Street West, Lindsay, Ontario, K9V 2Y6, either in support of, or in opposition to the proposed Minor Variances or Permission.

The Committee will make a decision according to information or evidence received before and during the hearing.

Any person or persons who wish to be notified of the recommendation and/or the decision with respect to these applications must appear in person or by counsel at the Public Hearing and in addition, request in writing from the Secretary-Treasurer copies of the decision of the Committee of Adjustment.
