Municipal Election Financial Statements - Candidates and Third Party Advertisers

The Municipal Elections Act requires all candidates (including certified, withdrawn, deceased or rejected candidates/campaigns) to file financial statements following each Municipal Election. The municipality makes them available to the public once they are submitted to the Office of the City Clerk and they are posted shortly after being formally received. 2025 Ward 5 By-Election: The last day the Ward 5 By-Election campaign period officially closes is May 26, 2025. The last date for candidates to file financial statements to the City Clerk's Office without penalty was Tuesday June 24, 2025 at 2:00pm. All candidates who filed nomination papers are sent formal notice reminding them of the deadlines and penalties prior to the end of the campaign period. 

June 24, 2025 - July 24, 2025 Grace Period: Candidates who missed the above filing deadline could have submitted their statement within the grace period, provided that they pay a $500 late filing fee. The grace period for the initial financial statement filing ends at 2:00pm on July 24, 2025 at 2:00pm. Candidates who file in the grace period will not be reimbursed their nomination fee. Candidates may file a Financial Statement in the grace period without the $500 late filing fee, however, the penalties in the Municipal Elections Act will apply. Candidates who fail to file a financial statement in compliance with the Municipal Elections Act within the prescribed filing period or grace period will be deemed as In Default an be ineligible for filing as a candidate in 2025 or 2026 anywhere in Ontario. 

2025 Ward 5 Councillor By-Election Financial Statements

In accordance with Municipal Elections Act Section 88.22(3)c the following candidates filed the required financial documentation, save and except those candidates listed 'In Default'.

Below is a list of candidates from the 2025 Ward 5 By-election who are in default of the Municipal Elections Act, 1996 because they did not file their financial statement (either at all, or on time) or exceeded the expense limit in the 2025 Ward 5 By-election.

The Municipal Elections Act, 1996 states that until the next regular election has taken place, the candidate is ineligible to be elected or appointed to any office to which this Act applies. If elected to a Council or Board, a candidate in Default shall forfeit their seat.

Earliest Possible Date for Candidates to be declared in Default: July 24, 2025 at 2:00pm

French Public and French Separate School Board Trustee candidates file their financial statements at the City of Oshawa.

Below is a list of candidates from the 2022 election who are in default of the Municipal Elections Act, 1996 because they did not file their financial statement (either at all, or on time) or exceeded the expense limit in the 2022 municipal election.

The Municipal Elections Act, 1996 states that until the next regular election has taken place, the candidate is ineligible to be elected or appointed to any office to which this Act applies. If elected to a Council or Board, a candidate in Default shall forfeit their seat.

Earliest Possible Date for Candidates to be declared in Default: May 2, 2023

Compliance Audits

An elector who is entitled to vote in the Kawartha Lakes Municipal Election who believes on reasonable grounds that a candidate or a Registered Third Party has contravened the Municipal Elections Act relating to election campaign finances may apply for a compliance audit of the Candidate’s or Registered Third Party’s election campaign finances. An application for a compliance audit may even be received by the City Clerk's Office if the Candidate or Registered Third Party has not filed a financial statement.

An application for a compliance audit must be received by the City Clerk's Office within 90 days after the latest of the following dates:

  • the filing date, which is the last Friday in March following the election (March 31, 2023);
  • the date the Candidate or Registered Third Party filed a financial statement, if the statement was filed within 30 days after the filing date, which is the last Friday in March following the election (up to May 1, 2023);
  • the Candidate’s or Registered Third Party’s supplementary filing date, if any, which is the last Friday in September in the year following the election (September 29, 2023);
  • the date on which the Candidate’s or Registered Third Party’s extension approved by the court, if any, expires.

The Compliance Audit Committee shall have the authority:

  • To grant or reject a compliance audit application;
  • To appoint an auditor to conduct the audit where the application is granted, and receive the results;
  • To commence legal proceedings against the candidate or registered third party advertiser for any apparent contravention within 30 days of receiving the auditor's report;
  • To commence legal proceedings against a registered candidate or third party advertiser for any apparent contravention of contributions within 30 days of receiving the Clerk's report.
