Municipal Swimming Pool Permits

Any private swimming pool capable of containing a water depth of greater than 1.2m (48 inches) of water requires a municipal pool permit.

The City of Kawartha Lakes Pool By-law 2005-314 outlines the requirements for the installation of both above ground and in ground swimming pools and the associated fencing requirements. The Pool By-law regulates all private pools servicing 1-5 dwelling units.

Do I need a permit for my deck around my pool?

Yes, pool decks larger than 10m² and more than 0.6 m (2 ft.) above grade at any point require a permit.

Do I need a permit for my pool shed/cabana?

Sheds larger than 15m² (161 ft²) in area require a building permit.

When do I call for inspection?

Prior to filling the pool with water.

Do I need a fence?

Yes, in the most common scenarios a fence is required. Specifically, an inground pool, a pool with a non-locking or non-removable ladder or when any of the pool equipment is close to the pool and enables climbing.

When does my fence need to be constructed?

A fence, even a temporary fence, should be in place once construction begins.

Can I put my pool close to my septic?

No, there are minimum required clearances to a septic tank and septic bed.  Pools must never be placed on top of your septic bed or tank.

Ontario Building Code Swimming Pools

The Ontario Building Code (OBC) regulates all public pools, which include private pools servicing 6 or more dwelling units. These pools must be applied for as an Ontario Building Code Permit. Common examples of public pools are pools servicing trailer parks, cottage establishments and hotels/motels. A building permit is required to install these types of pools.
